Madison, WI (AHN) - A Court of Appeals has dismissed attempted sexual assault charges against three men involved in necrophilia after it was found that Wisconsin has no law against having sex with a corpse.
Twin brothers Nicholas and Alexander Grunke and Dustin Radke, went to a cemetery in Cassville in southwestern Wisconsin on Sept. 2 to remove the body of Laura Tennessen, 20, who had been killed the week before in a motorcycle crash.

Good lord, son. If we started throwing people in jail for conspiracy to do something stupid and disgusting we'd have no place to put them all. And any good lawyer is going to be able to quash a conspiracy charge when there's no illegal act planned.
If the State's Atty wasn't such a glory hog, he would have booked them for trespassing and vandalism. That would have stuck, and it's likely one or more of the three are on probation and could have been sent back inside for the violation. Of course, it wouldn't have made the press--but what's Justice and the Public Interest weighed against coverage that could help a guy's carreer.

Personally, would like to hang them from a high place by their privates; however, under the law, it is very hard to convict a person on what they have planned to do (expect attempted murder, which is taken much more seriously).
OH MY GOSH...Sick and unpalatable as it may be...why do we have to LEGISLATE everything in our nation.Breaking and entering.trespassing FINE charge and prosecute...seems to me a good mental evaluation and treatment is more in order then JAIL time. but what do I know.My first impulse is to agree with the poster that said that one or more of them probably already were on probation.I would reason to guess that most people's first act of deviance is NOT attempting to dig up a grave and have sex with a corpse.deviance unfortunately in most cases is progressive...I would venture to guess that at least ONE person that is familiar with the accused WAS NOT SURPRISED by this act.punishment and an attempt to guard society from further deviant acts committed by these dummies should be the main goal of any legal proceedings..however do we really need a law that says it is illegal to have sex with a corpse? When getting to the point of being in the position where that is even possible to attempt this, a number of criminal acts have most probably already been committed. I may be foolish in my line of thinking...but time in state legislature can probably be better spent then making a law of this nature...probably are more relevant issues at hand...even though this is revolting and evokes a lot of emotion.
