Teen under 18 years of age questioned witthout parent or guardian present!?

O.k. someone very close to me was called in by the police and questioned...she is under the age of 18 and did not have a parent or guardian present.this is illegal and can have charges pressed on the police enforcement questionioning correct? o.k. she was questioned harshley and falsley like cops do to try to scare you to admit fault when they have a dead case and nothing against you. she has eye wittnesses saying she was home at all times while the crime was committed but they say she is the lead suspect.and her parents are outraged by the false acusationg adn questioning without them being present and want to retalliate...sooo my question is can they get a lawyer and put them in their place for questioning her without parents present?

As far as I know the police can question all they want, with or without a parent/guardian present. I know I have been questioned before I turned 18 by them. As far as taking legal action, I don't think that will get them anywhere. I would just say make sure you children are aware of the laws we live by (5th ammendment) because if she knew how to deal with the police she wouldn't have even had to say anything to them.


The police can question a minor w/o a parent present. Who told you otherwise?
Well, you say under 18...I know here in TX, 17 is an adult.
I think they are allowed to question the suspect, but the suspect (under the Miranda rule) have the right to remain silent until a lawyer is present.
They can question anybody they want. Cops do what they want.

They're above the law.
NOT NECESSAIRLY...DEPENDS ON WHAT STATE THIS TOOK PLACE IN. SOME STATES HAVE A 16 Y.O. RULE...OTHERS ARE DIFFERENT.ALSO IF SHE IS NEVER CHARGED..NO HARM NO FOUL.
