How do you protect yourself from slander?
I wear prescription safety glasses at work. The main ingredient in the cleaning solution that the company provides is alcohol based.I have worked at this company for four months and the person that I believe is spreading these lies has spoken to me maybe twice. I do drink but not before work. (I work second shift.) The plant manager had spoken to me and seems to believe me, but what she said with out naming names leads me to further believe that the person I suspect is saying these things about me. What can I do to further protect myself and my reputation from further harm?
Answers:
Slander is a form of spoken defamation. You may file suit for defamation, seeking an injunction and potentially damages.
To prove the prima facie case for defamation you need to show that (1) a defamatory statement was made by the person you are suing; (2) publication, (3) damages.
A defamatory statement is an allegation of fact that reflects negatively on a trait of character. I assume he is stating that you drink before your shift. That would be an allegation that you have bad character, that you are irresponsible, and that it affects your job. Then you must allege publication. If the person has told even 1 person it has been "published". Thus, if he has told your supervisor, that element is met. Then you must show damages.
Here, since the issue is slander, you must prove actual damages unless it falls into one of the categories of slander per se. Slander per se has presumed damages. One of the categories of slander per se happens to be defamatory statements made with regard to someone's business or occupation. Thus, since the person is making statements with regard to your occupation and to your supervisor, you fall under slander per se and need not prove actual damages (which based on your facts probably don't exist since you have not been fired, demoted, or otherwise penalized). Thus, you may seek an injunction, or restraining order to prevent the person from disseminating defamatory statements. Further you make seek damages as well.
Hope this helps.
