Caught with adderall will I go to jail for haveing 2 30 mg xrs?
Hi I recently got caught with a small bud of marajuana and 2 30 xr adderall capsules...I live in NC. my ticket says GS.9095(a)(4) any idea what that means?
Answer:
From my understanding, the ticket is referring to the crime which was committed according to the statutes of legislative law.*
GS is an abbreviation of "General Statutes"
90-95 refers to the chapter(s) of the NC's Criminal statutes that you supposedly violated under state law
A(4) gives specific provisions regarding the alleged offense. If you haven't yet been brought before a judge, the number on the ticket entailing your offense*** will be read during your initial appearance in court along with the consequences of the charge if you are found guilty.
*Most offenses involving controlled substances in North Carolina are not criminal
Initially your charge may be classified as a Class IV felony, but it will end up being a misdemeanor offense (less then 6 months in jail & fine; although almost always commuted to probation and fine) assuming this is your first or second offense
**if you have had previously broken the law and have charges pending, failed to appear in court for prior offenses, or were suspected of being under the influence when caught during a traffic stop, etc)
