What are my rights? I need to have peace and quiet in my own home! Please HELP!?

Hi, I am studying for my exams for my BS in Nursing. My test is on Thursday and I have been studying for weeks. I have taken off from work and sent my children to the beach with my mother this week. I have gone through alot of trouble to have the time I need right now. I am missing my kids and my pay from work.

My problem is my neighbor has some sort of construction going on next door and it is LOUD! I do not have anywhere else to study, the only other place is the library and it is across the street from this neighbor. My grandmother's house is out in the country and would have less noise but my grandmother is very talkative and I know I would get nothing done. It has been going on since 8 this morning and it is now almost 3:30. I am fed up and frustrated. What should I do? The neighbor does not like me and has expressed this openly so asking for her help is not an option. Do I have the right to ask for the noise to stop? I do not have a home owner's association in my neighborhood.

It appears that there is not much you can do..make sure you are aware of legal construction times in your area and then go on the attack..sounds like maybe Grandma is the way to go...send her to the movies or something...anyway, I wish I could give you answers but I have tried to silence even the dogs and it seems that all have the right to make noise but we have no right to silence.
Oh, I just thought of something.."white noise"...raise you music to a level that is above the construction...the brain will get used to it after a short while then you will not be bothered by the outside noises and it will drown out the construction..and you can play music longer by most laws so it will be your turn to annoy your neighbour should you have a vindictive streak at all..and the "white noise?" it works..I worked nights all my life and would play the radio all day so any outside noises would not awaken me.


How about ear plugs? Keep the phone in your site so you can see it if it rings.
Does he have a building permit? It should be posted outside. If not give your local government a shout, this will silence him.
Next you'll be complaining about that horrible smell from the cookies she's making.

sounds to me like you need physciatric help more than you need a nursing degree
You most likely don't have a legal leg to stand on with regards to asking your neighbor to stop with the noise because, more than likely, he is not violating your town's noise ordinance. (Typically a town's noise ordinance will run from night until the following morning and any loud noise during that time is a violation.)
you have every right to ask that the noise stop.

And the neighbor has every right to tell you to take a flying leap.

It's time for a local bookstore or library or go to the college to study.

What about studying at a friend's house or at a local school?
You may want to check with your city regarding noise ordinances. I know where I live noise can be prominent until 11:00 PM. I have battled my neighbors for years to get them to adhere to the city noise ordinance. The problem I have is the police do not want to enforce it as it may upset my neighbors (?)
Virtually there is nothing I can do to stop the noise. You may want to have your spouse or a friend build you a noise free room.

while i understand your complaint,you need to understand your neighbor has the right to do to his home as he wants. you could check with the city to see if they have a building permit,but that will take longer than you have. you must live in a very small city if the library happens to be right across the street from you. library usually have fairly soundproof walls. if the noise is that loud,then you could call police and ask them to to speak with your neighbor.
My suggestion, bring your kids and mom home from the beach, let them stay in your house and you go to the beach... one more thing, try not listening to the construction and concentrate on your books you may find that the noise will eventually fade into the background and you won't even notice it.
you don't have a leg to stand on, it is unfortunate that it is loud however they are well within their rights to do work on their house within day light hours.

Had this have been prior to 6 am or after 11 pm it would be anohter story.
