What is the charge for first dui in north carolina?
Answers:
If this is her first offense she will probably face the following:
1). A fine of several hundred dollars and court costs.
2). She will have to take an alcohol assessment and pay for that.
3). Her license is already revoked for 30 days. She will have to pay a restoration fee to the court ($50) to get that back.
4). Upon conviction her license will be revoked again.
5). Because she blew over a .16 she will have to have an interlock installed on her vehicle and she will have to pay for that too.
6). She will probably be sentenced to 30 days in the county jail. This will be suspended (means she does not have to serve it as long as she complies with the sentencing).
7). She will have to do either 24 hours of community service or jail time.
I think I got most of it. There may be one or two little things I left out. That is pretty much a standard one for NC DWI conviction. The judge has some liberty with it but not much since the law spells out what the minimum punishment will be.
Her insurance is also going to go way up. But that's her insurance company not the state.
She should probably go talk to a lawyer. Where did she get this DWI?
I don’t know, but I hope they take your license (there is no excuse for driving drunk!), because I live in NC and I don’t want to be on the road with you, nor do I want my kids on the road with you.
