Awaiting psychiatric reports before sentencing ,just what does this mean?
An 18 yo lad on our street has just been to court and according to the local papers he was up for strangling his great grandad (but not killing him),beating up his 15 yo girfriend, covering a police man in flem, causing hrassment on various occasions, the list is endless..is he likley to go to prison like he should or will he be let off with sympathy and allowed to claim lots of benefits and classed as disabled
Answer:
Psychiatric assessments are only usually undertaken if there is reason to believe that a person is/was not of sound mind at the time of the crime. If they were deemed by these reports not to be/have been then it is classed as diminished resposibility under the mental health act. In this case the person is likely to be held under the same act for further assessment/treatment and be released when deemed to be of 'fit' mind. If the reports suggest otherwise they will be held fully accountable for their actions and be held for their criminal convictions as stated (probably a while by the sounds of things!)
Beats me
depends on what the reports say. he might not.
Determining if he was mentally competant when he did it. Standard in serious cases. If he's competant, he's going to be away a while
lets the law enforcement people know which place to send lawbreakers, funnyfarm or jail
That depends on which state you are from and what kind of lawyer this kid has.
probably be to decide whether he should be put into a normal prison or a special psychiatric one. If he is found insane i doubt he will be let back into society as he is obviously dangerous
first if he is classified as a psych he doesnt get to just go home. they will put him in a psych ward where his freedoms are comparable to a jail, the time frame is usually the same. sounds to me like they will be testing him for anti-social personality disorder. Either way he probably won't be sentenced that much time in jail due to his age and the fact that no one died. There is too much over crowding...that of course doesn't mean that he only deserves a short time. sounds to me like he needs psych help!
he should but if hes "metally impaired" then he'll probably be let off bc of all the stupid liberal judges out there
depends what the report says, if he plays them saying he has mad turns, then he will get off with it, it is a totally joke, these days, you can get away with anything, keep safe all the best
Most states have a unit it prison for the mentally challenged instead of general population. Although sometimes they are housed in general population but sent to special classes to teach them how to cope in general. that is what the waiting for the psychiatrist is for, not to release him to the general public.
all Republicans need them
It is reasonable to have these reports along with social enquiry reports prior to sentencing.
What is not reasonable is that these reports could have been done in the months leading up to his trial. Yet another scam to waste time and screw even more money out of the system.
Some years ago a young lad damaged all the cars along the road he then ended up in court for hitting a police officer while being arrested for stealing a motor bike after the judge asked for psychiatric reports he was let off
WHY
He was not breast feed as a baby
Don't laugh its true
i dont know offhand, if he has a shrink claiming that his acts are as a result of his mental health (ie directly responsible as in hes schizophrenic or prone to psychosis) then a psychiatric report will just determine how long he goes to a mental hospital, but from the sound of it hell probably be going to prison
depends how good his lawyer is
