My friends were drinking in the car but i wasnt drinking and i got a summons what do i do? have to go to court

Answer:
Your friends will have to accept their own culpability and testify that you were not drinking.

Realize that possession is 9/10 of the law. And keep your mouth shut. Don't argue with the judge or the cops. Trust me on this.
have your friends tell the judge that YOU were not drinking.
what were you thinking getting into a vehicle where people were drinking? you had a choice...get in or get out. you chose to get in. now you face the consequences.

next time: choose better friends
do you have a proof that your weren't drinking, if so then go for it !
If your the driver and there underage your responsible for their actions. If this is the case your mates have put you in the S**T
drunk drinking is taken by da cops seriously you could have yo go to prison..they have a device that can tel them what you drunk and when you drunk.
the police would have the record for im sure they tested if u were drunk that night , this could be the evidence, if u know u r not guilty u should not say u r because if u do u will have a criminal record for the rest of ur life, ask ur solicitor what evidence do they have against u and how strong it is. make sure that u have enought of it to stand against the police.
I suggest that you goto court and face whatever results from it. If you were not drinking, then you obviously can't be punished for being drunk. If the driver was one of the people drinking, than there may be consequences for knowingly riding with a drunk driver. It also depends if the people drinking were underage or not.
Where you driving the car?
they submitted summons without doing a exhale test of you..seems very strange. anyway, go to court and tell the truth and tell that you were never tested for alcohol.. that's what you can do and nothing more..and last but not the least, be prudent in future.
If you lay down with dogs, chances are you get up with fleas. Guilt by association. You would have to have everyone in the car attest to the fact that you were not drinking. Also if the cops did not give you a test for alcohol, that's another plus! IN some states, if your with underaged drinkers and you are with them, you will also get a summons. Explain to the Judge. He might believe your story if all the others state that you were not drinking.
Were you the driver? In most jurisdictions, if there is an open container in the car, the driver is presumed to be drinking. In some states, the open container is itself the offense. The reason, even if you're not driving, is that rowdy passengers are a risk to other traffic on the road, even in the (highly unlikely) circumstance that the driver is not drinking. If you were not the driver, and not in possession of the container, you might have a defense, but suspect that you were cited as being the driver. Your license could be lifted, and your insurance rates will go sky-high. (If you're not already an assigned risk, you will be at the next renewal.)
You got a summons so yes you have to go to court. Did they do a sobriety test on you? A breathalyzer? Usually they would do these and these tests would tell if you had been drinking. If they did none of these tests -you better hope your friends will back you up.
Stay away from people who drink. In court tell them you were not drinking, and hope they believe you.
