I need advice..?
Yesterday while grocery shopping at my local WalMart..I slipped and fell on the wet floor. They have a Culligan Water system that lets consumers fill their own containers, and someone left a trail of water from it.
The Coca Cola distributor was restocking the shelves and this happened right in front of him, and my daughter was also with me and witnessed it.
I fell on my behind but most of the fall was on my right hand, which is bruised and my wrist is very sore. I am a card dealer and use my hands constantly while at work.
I know with time the bruise will heal and the pain will subside, I'm just wondering if this happened to you, what would you do.
Please, this is serious, I am not joking and would appreciate serious answers. Thanks

You can sue and WalMart's insurance company will probably make you an offer of about $500 to $1,000 just to get rid of the nuisance law suit you represent. Slip and fall lawsuits are common as dirt to retail establishments and their insurance companies.
Your chances of winning in court for more money then mentioned above are anyones guess for juries do strange things.
If the water on the floor by the water dispenser was dropped by one - (note the word one) - customer and this happened only moments before, then your chances of winning are pretty slim. If this was a persistent problem with water accumulating from many customers then your chances would be greater of convincing a jury. You will have to prove the water was a persistent problem at that location if you have any hopes of winning.
A case I know of similar to yours turned on whether the grape a woman slipped on was dry and thus hard indicating it had been on the floor for some time, or wet indicating it had only recently fallen to the floor and the store could not have reasonably been expected to know it was there.
I would have spoken to the store manager yesterday when it happened so that someone was there that actually witnessed this accident take place in their store.
Today I would put ice on my wrist and call Wal Mart and speak to a manager and ask them if there is a report that needs to be filed .

Well, first of all, do you actually have a serious, long-term injury, or just a sore wrist? If that's the extent of your injury, you don't really have a legal case, even if you are a card dealer. If there's a fracture or a tear or something that may need surgery, that's your starting point. Then you need to know if the store knew or reasonably should have known about the hazardous condition. Has this happened before? Do they need to do frequent moppings because of it? Do they have mats down in the area? If they took reasonable steps to make it safe, and this trail of water was not reasonably foreseeable, then again, you don't have a case.
