Can I find a attorney that can sue my wedding photographer and make him pay the cost?
I felt like I got scammed. I hired a man to photograph my video graph my wedding on 08-26-2006. He was unable to give me my photos 40 days after the wedding as he stated. I ended up receiving my photos like the end of March of 2007. The pictures that He gave me were not professional they were blurry dark Etc. I was unhappy with those pictures. Up to this date he still hasn’t gave me my video packet. The packet includes 500 pictures, 2 DVD of the wedding. I had to pay before August 12, 2006 (for the amount of $1211.11). I tried to keep insisting so he can give me my things but it’s been such a hassle and frustrating. I don’t know if I can still sue him because of the time I let pass by. His info: Commerce Logistics www.commercelogistics.com...

Consult a lawyer. Usually consultation is free. They willl be able to tell you your probability of winning a case against him.
I would.
Ask him to redo your wedding, put an artificial display with colors, candy, flowers, and everything else... that way you will have memories.. maybe stage a four day vacation get away with your husband where you are both immersed in a luxarious enviorment and have him photograph those moments... and then threaten to sue him if he doesn't offer any compensation. Try to get the most out of a bad deal.
I would do everything possible for him to pay. That is one of the most beautiful days in your life..dont let him get away with it! GOOD LUCK
why dont you call an attorney an ask...free consoltation
yeah u can sue him if u had a riten agrrement saying that u wood pay 4 the photos and video's but u never received them ...do u have any thing showing your agreement ?
sue his *** so bad they garnish his turds, or have your hubby go after him wit razor blades and lemon juice
If a woman found a lawyer to sue mc. donals for some "very hot coffee", you can find one for your photos.
yes you can still sue him.yes some time has passed, but all u need to do is explain the situation at court and tell them that u were told that the package was on the way.but after it being this long, u figured u werent getting them and thats why it has been such a lengthy time. but believe me, ive watched enough court tv, if u get an attorney and sue.u will win and he will pay. just bring ur proof of terrible photos.
Since your claim is relatively small, you should try filing in small claims court. The fee to file your case is small, and you won't have to pay an attorney. You can argue your own case. He may decide to settle with you before it goes to court. If you go the attorney route, your case may cost several hundred dollars.
Also file a case with the Better Business Bureau. They can't force him to pay you, but they will let both of you tell "your side" of the story and anyone who wants a wedding photographer will be able to pull up a report about him if they determine that he has not lived up to his end of the bargain.
Consulting an attorney is useless because your claim is under $5000 which makes it a small claims court issue. I do, however, think you have a viable case. If you go down to your local city hall or justice court they'll be able to tell you how to file a claim to sue him. If he doesn's show up for court, you automatically win your case. If he shows up and you're able to prove your case, the judge will find in your favor and will order the photographer to pay you back plus your court costs.
BTW, you CAN hire an attorney but it's redundant and, in most cases, costly. Most judges will NOT award you attorney's fees on a small claims case.
Hope this helps!
I would feel you have a case,
but you should talk to a lawyer
tell the lawyer what happened and ask what your options are
to me this appears like a miscommunications.
how the disaster impacted you
Sue him in small claims court. Go to the local court house and ask how. No lawyer will take this case.
I think small claims court would be the place for this. I don't think any attorney would sue someone for $1200.00. It would not be worth their time, and also, if the photographer is a small business person, there's not much more to collect.
Let me tell you, we went through the same thing with our wedding pictures, took a year to get our album from our photographer. He kept giving us the run around. Anyway when push came to shove, I called contact 5 ( here in Las Vegas ) the local news channel that will help people that is having problems with local businesses. I contacted BBB, also if there is a place to write any comments online regarding the photographer I would tell the story so EVERYONE that is looking on booking them for their special occasion would know how he handles his costumers! After I had done that I had then called his office again after I done all that and let them know that I have nothing better to do with my time than to stand out on the sidewalk with signs to let everyone know how he does business. ( not on his property ) Check into local law where you live first if you really go through with it. We never ( my friends and I ) went through with it. We finally after a year of begging got our wedding album! It was nice to look at the pictures and reminisce, with something we should have got many many months earlier. Getting a lawyer, will only cost you more money than what you have paid. If these steps don't work, then look into small claims court. Take care of it yourself. It will cost less. If you have any questions feel free to email me. Hope this helps.
