Do I really need a Lawyer / Attorney??
How dose one, find a great injury attorney in Orange County, CA?
Do you have any recommendations on good and bad attorneys?
Moreover, what is fair to pay them?
30% plus all expensive, seams to lot for doing nothing more than writing a letter, doesn’t it?
Do I really need a lawyer to handle my case?
Will they really get more than I could after taking out 305 plus all their expenses?
I have over $10 in Medical and another, $10K in missed work, plus pain and suffering?
How much will I get?
Answers:
No one can tell you, based on the teeny amount of information you have here, what you could win.
That's what lawyers are for, and why they make the big bucks. They will be able to assess your case, have medical professionals review your records, (pay for) and have your records copied and delivered to the proper people, research who you will be suing and how much you would sue each party for, etc., etc.
It is absolutely a better idea to get a lawyer to do it for you, mostly because injury cases take a lot of manpower, hours, records, and very detailed reports, and it's difficult to coordinate if you don't know what you're doing. Most injury attorneys will also take the case on contingency, and if you don't get paid, they don't either.
Go to the Orange County Bar Association for a referral.
There are lots of good personal injury attorneys in the OC. Call the OCBA lawyer referral service to find one.
These cases are on a "sliding scale". The percentage the lawyer gets is usually lower if it is settled by "writing a letter", goes up if a lawsuit must be filed, and goes up again if it has to go trial. The percentages are negotiable when you hire the lawyer.
Do you really need one? Only if you want to win. If the other side has insurance, they will have a lawyer. You already have a job--let a lawyer do theirs for you.
If you hire an attorney, the attorney will make sure all the right forms and documents are filed in the right place, and keep track of all deadlines. They will also respond to all responses by the opposing party, and negotiate any potential settlement more effectively than someone who is not represented.
The attorney also has (hopefully) an expertise in evidence which will be necessary at any hearings or a trial.
There's an old saying: "He who represents himself has a fool for a client." If you actually have a valid claim (which an attorney can assess) that is worth significant money, an attorney is worth the price, since you stand a better chance of recovering something than without him/her.
30% is very resonable, and is lower than others. Don't concern yourself with the attorney's expenses. however, the costs of the lawsuit may be high. Any doctors, experts, filing fees, court costs, and other fees and costs are yours to pay and may stack up. I don't think you'll find an attorney willing to pay these out of their own pocket.
If you've got a good case, and found a decent attorney for 30% plus costs, I'd suggest going with the attorney.
If you win, you could recover any actual costs (lost wages, medical bills) plus any future losses (future med bills and decreased capacity) plus pain and suffering (which can be substantial) and other losses which an attorney can identify. If the conduct of the opposing party was wrongful, you may be entitled to punitive damages as well, which can be substantial.
