What happens if one parent doesn't show up to the custody court dates?

Unless they have a good reason for not being there, the parent that does appear will win by default...this can vary from state to state, and even court to court. In some cases the court or judge will postpone a ruling just in case something legitimate occurred to cause the parent not to appear in court. After all, we are talking about custody of their children. The judge may give the parent the benefit of doubt that they wouldn't show up unless there was a VERY good reason.

No matter what, if the reason is not legit, it will reflect negatively on the parent that doesn't show up. It could be enough to sway judgement to the parent that did show up.


when one parent doesn't show up to a court date it doesn't mean that they will loose, however it may reflect badly depending on the reason, it could possibly flash the "this person doesn't care enough about their kid to show up" but that just depends on the judge.
The other parent gets custody.
