Can Police Officer break the Law to catch some one which breaking the Law?
Answers:
A police officer cannot break the law to catch someone breaking the law. It is a violation of a legal precedent known as "fruit of the poisoned tree". Anything that occurs after that violation is not admissible as evidence.
If you're referring to a police officer speeding in order to catch someone, or running through someone's backyard to catch someone, they're not breaking the law. A police officer is permitted to take "reasonable action" and use "reasonable force" in order to apprehend a suspect.
However, if you're thinking about the gathering of evidence towards an arrest then no. A police officer cannot break into someone's house to look for illegal drugs (for example) even if they suspect they're there. They must have a warrant.
Interesting fact: a private citizen has more arrest powers than a police officer. It's true. A private citizen can affect a lawful citizens arrest on mere suspicion, while a police officer must have probable cause and follow police procedure.
Technically no, could you be more specific as to which law the police officer broke?
if they want to!
THEY DO IT ALL THE TIME INCLUDING DRIVING UNDER THE INFLUENCE!
they can do whatever they want. they are above the law. i hate pigs. anarchy through capitalism. SRH. KMK for life.
Legally, no. During a police chase they are allowed to do what they need to. On other issues..NO. They can not legally break the law in order to enforce it. LOL. But please, dont hold you breath waiting on intergrity out of a cop. Cops do whatever they feel that they can get away with and dont concern themselves about right and wrong. Remember that.
yes such as speeding or driving the wrong way down a one way street
I guess you're most probably talking about speeding. Speeding is legal for police and other emergency vehicles in the line of duty. If someone were in your home holding a gun to your head would you be complaining of the police speeding to get there?
well, no. But you know they still do it at times.
Some would say look the other way as long as they are getting the bad guy. But what if in breaking the law, they arent getting the bad guy but actually getting someone who is innocent?
depends on the situation. but i think as long as they don't break any "constitutional laws" that protect the suspect then they are ok.
They break the speed limit to catch crooks doing the same thing.
