I just heard that there are several thousand "no-knock" warrants issued yearly. Is this true?
Can enforcement personnel secretly go through your home while you are away?
Is there any truth to this?
I was thinking this sounded more like China, North Korea, or the former Soviet Union.
Answers:
Yes.
No-knock warrants are getting innocent people killed. And when the facts between the police and the victim are unclear, the police generally win.
As for government personnel going through your home while you are away, I wouldn't put it past the govt. to give itself this authority.
Especially when you look at the 750+ signing statements Bush as put on legislation exempting himself from the law, not to mention the dozens of executive orders he has signed.
YES!
if they have a warrant to do so then yes they can do so without you being present but for there to be a warrant issued there has to be just cause
sure..more then that actually...a search warrant is issued and provides you with all the safegurards of the constitution...you do not have to be home for any search warrant,a no knock means you can enter with out warning...to keep wormheads from flushing their dope..a regular search warrant can be served anytime...even if you are not there.china notwithstanding
No, for the authority to enter your home, they still need a search warrant in which they have to show a judge probabal cause of a crime. Yes, if they have a warrant and you are away, they can still serve the warrant. Anything and everything must be inventoried that is removed and a copy of the warrant has to be left in a visible spot with an itemized list of everyting that was removed. This is nothing new to serving warrants. You need to stop listening to your communist friends and the media. Even with the patriot act, all searches and wiretaps MUST have a warrant signed by a member of the judicial branch. If you have done nothing wrong, you have nothing to worry about..comrade.
I imagine it is true, depending on your source.
All the same, the police generally have good reason for a no knock. Still, anyone who smashes down my door generally would get a 12 gauge shell at worst, so I hope it isnt the police.
...Then again, I dont give them a reason to smash down my door :)
A no-knock warrant is NOT about entering your home while you are not there. A no-knock warrant is one that allows police to enter without announcing themselves and giving anyone inside a change to answer the door. It is usually used in drug raids or other cases knocking is likely to result in destruction of evidence. An ordinary warrant can be served when you are not home.
Yes, it is......Yes, it does.
yes there are no knock warrants, why are you so scared of warrants anyway? do you have some reason to think you might be a target by a law enforcement agency?
