Can somebody under 21 drive when all the passengers in the car have BAC's over the legal DUI limit?

Can somebody under 21 be used to provide a ride for a group of people over 21 who will be out drinking? The under-21 will not be present, but will merely drop the group off and go back to his or her place of residence until the function is over, and give the group a ride back home.

Answer:
Sure, as long as they have a valid license.

Absolutely! Good for you to set up sober driving boundaries from the start. I wish more people were as mature as you about the drinking and driving situations.
Depends on state laws, but if the person driving has not been drinking, as long as they have a valid driver's license there should be no problem. At least the passengers are being responsible and designating a sober driver. I know in my state, people under 21, but 18 years or older, are allowed in bars, have to get stamped with a special stamp and are subject to BAC tests going in and coming out of the bar. Many people around here will take underage friends with them to be designated drivers. You get free soft drinks all night long!
Between 16 and 18 no you can't. In fact, you must have a person with a drivers license with you that is over 25 and not intoxicated.

In my state I imagine you can once 18, however, my state passed a vertical license law so they could identify all those on the road under 21!

Each state is different so go here and you will find every states laws and rules:

a licensed sober driver should be driving

if you cannot manage that, NOBODY should drive

call a cab

meanwhile, nobody should be drinking over the DUI limit; there is such a thing as alcohol poisoning and it can be fatal, in case you don't know that

meanwhile, the wrong driver can kill you all and some innocent other person on the road, like a little kid ...

bottom line, a LICENSED driver
sure, as long as the driver has a license he or she can drive anyone anywhere and it might be a good way to make a few bucks. (Or your riders could get a cab...)
