Can i sue my lawyer?

We moved from Canada to the US almost 3 years ago and now applying for Green Card, but our lawyer is so dumb he has been making mistakes and errors multiple times in the past few months on important documents, its to late to change lawyers also. Today was the final set of documents before we send it in and there were well more than 30 spelling mistakes, errors, grammar mistakes on all the important papers.

Now let say i cant get my green card because of my lawyers's dumb mistakes, am i able to sue him?

Answers:
Yes. You sue for malpractice. Also, you should file a complaint with the Bar Association of the state you are in.

okay by me.
I would think you would be able to appeal a decision that was denied solely on spelling errors...
Sure.
Just get a new lawyer.
Where do you think you will find a lawyer to file the lawsuit?

Sorry, but suing lawyers really isn't likely to be an option for anything less than theft of funds.

However... I can tell you that grammar isn't generally that serious an error. If they can decipher it, the errors won't affect you. The only spelling errors that MIGHT make problems is if the final submission mispells your name.

I confess I'm not familiar with Immigration Law, but I do know that spelling errors would have to be really REALLY severe to cause a loss to a client. What they do is make the lawyer look like a fool to the Judge or bureaucrat that sees them, but I think that they will be very unlikely to punish you for it.

If it's too late to change, then ride it out. If they kick it back because of these errors, THEN you might want to report the matter to the State Bar Association, who will direct you to where you formally file a grievance against an incompetent lawyer.
