How do I take someone to small claims court?

My roommate owes me money for a security deposit and she refuses to pay me. The amount is only about $300 but I still want to try to get it back. Can I do this? Where should I start?

Yes. Go to your local courthouse, and file a complaint.

Also, take pictures of the room (I don't know your circumstances), and have copies of all paperwork involved to provide evidence of your claim.

By many state and local laws, Landlords must keep Security Deposits in Escrow at a rate of return (usually around 3 or 4 percent per year is due)


Go to the courthouse. See the clerk. Fill out the paperwork. Have someone else serve your roommate. File the papers back in court, get a date. Show up with your proof on the date and get a judgment.

If you want to know how to collect the judgment, you'll have to ask again. It's a whole different problem and it's not easy.
Yes you can.. Contact the Clerk of the Court in your county/city (courthouse) and they should be helpful.

They however cannot and will not give any legal advice. You simply need to know how you go about filing... Which forms, filing fee, etc.. Make that clear to them.
