Is the good samarian all dead and gone today? or is it that law which everyone is using against people who try to help other people who are in need of help?
On the news , a city is sueing people of the city who did not stop to help this woman who was dying but everyone walk around her and no one stop to help her. She was on a busy street's sidewalk.
My son said that there is a reason for it and they should change the laws and make it so no one can sue a good Samarian.

i agree that it is terribly sad that in large cities (where you have many kinds of people), most people are too self-absorbed or in too big a hurry to stop and help those in need. However, the Good Samaritan law is supposed to enforce a sense of civic duty amongst the populace, not punish them. Apparently, no one did. Now, some of those people must answer for it. Indeed, i think that everyone SHOULD help another if they can. In fact, is that not the entire principal of FreeLawAnswer.com in the first place?
Your son possibly misunderstood the news bit. Any legal action taken will be against those who did NOT help the woman, rather than anyone who would have.
i would have offered her help. Any of my friends that i go places with would have helped. And i truly believe that this instance you're citing is an exception rather than a rule. i hope that most people are not so stoic.


I am sorry, but I do not understand your post. Did the city sue those who just walked by that woman who was dying on the streets? If that was the case, then I agree with the city. How could a human being not help someone in a life and death situation?

I also did not quite understand your son's comment. Did he mean that the city should NOT sue those who do NOT help those in need (i.e. a good samaritan)? If that were the case, how would your son feel if that woman who died was you or someone he loved? He would not want someone to assist you?
the good SAMARITAN law does not exist here in Kansas.

That store is down the street from me but it is not a store where I shop, this part of town is being inundated with gangs,drug dealings,home invasions, and people not being safe to protect their own homes and families.

The fear *many* people have is that if they help someone that they could be sued anyway, it has happened when some pulled a person from a car wreck and the victim had damage, everyone just cares about money anymore and they don't care who they hurt to get it.

One issue in this case is no one called ems or police for 20 minutes, and took pictures with their cell phones.
yeah why stop and get sued or aids hep or killed thats what police and ems are for
It is wrong but ,if you stop to help someone and mistakenly make thing worse they can sue you. Just like if someone goes on your land with or without premisson and hurts themselves they can sue.
I think your son has the right idea, but you have to be careful because there have been cases in which doctors have stopped to help injured traffic victim's and later brought into court because the victim claimed he either didn't do enough or did to much, a no win situation, ergo few doctors will stop for fear of being sued, really sad ,the way some people are , anything for a buck.
In that city the people may be afraid of being held responsible for the dying woman predicament,may be the law may turn againts them for trying to do good.The govt. should look into this because many have suffered alot in the hands of law for trying to help sufffering people. I still beleive that there are still good samarians who will not mind whether the good they want to do may turn against them,they went ahead and did it. Lets be our brothers keeper.
Nobody helped her? What city was she in? I'm glad I don't live there!! I'm from Texas gulf coast and we may sentence people to death but whenever I have passed an accident or someone needing help, if there isn't a good Samaritan already helping, I always stop and help. If there is ever a person pulled over on the side of the ride that looks like they need help, my husband always pulls over to help, even if it was just to shine a flashlight for the person while they changed their flat or to let them use the cell phone.
One time there was a homeless lady kneeling and praying on the shoulder of the street, I passed her in my car, then turned and went back to ask her if she was ok, she didn't respond so I got out and tried to talk her out of the street. Other people then stopped and also helped. We called an ambulance and she was taken to the hospital. She obviously was not all there mentally and hopefully she got some help.

So to answer your question, yes there are still good Samaritans, they live on the Texas gulf coast and no, they should not be able to be sued for their good deeds.
