Is Deferred Adjudication offered in California?
i've only read of situations where this is offered in Texas and for things as small as speeding ticket and as high as felonies (i could be wrong on that).
is this offered in California? and is it wise to ask for it?
Answer:
In California there are two different programs, called diversion (which happens before conviction) and deferred entry of judgment (which happens after conviction). In either case, upon successful completion of the program the charges are dismissed.
Upon approval of the prosecutor and/or County Board of Supervisors, most misdemeanors can be diverted, and there are specific programs for bad checks, child support, developmentally disabled defendants, etc. Deferred entry of judgment is available to qualified defendants in a wide range of drug offenses, including felonies, but not the more serious offenses, such as sales.
If the program is available, in most cases it will be the best route to take.
