If my company loses my personal information, is that a violation of the privacy act?

The company that I work for collected personal information to perform a background check on me (including fingerprints). My manager informs me that the information has been lost. Can I take any legal action?

Answers:
yup i think it wouldnt hurt to google or to ask a lawyer

you might want to talk to an attorney about it. Or at least talk to the owner of the store about it and tell them that if they don't find the info that they will have a lawsuit on their hands. Someone could use you for identity theft, and the list goes on. There are so many bad things that could happen to you because of this. It doesn't really makes sense how they would lose this information since everything should be stored in a file cabinet that is locked anyway.
First I would make a police report. This needs to documented. Next you need to check with an atty. to figure out if your place of employment can be held responsible IF in fact your identity is stolen. I would then monitor my credit report every month to make sure there is no questionable activity. Since you filed a police report you have proof that your info was lost and made available for identity thieves.

You need to let your manager know that you are not happy about your information being "lost". This usually means that someone either broke into the office and stole the files, or someone took home work information (check your work handbook - this could be against the rules).

Hope this helps
