Did WE destroy Padilla?
What does America do IF it turns out that Padilla, A US citizen, is a shattered man, after nearly four years, without charges? I'm perfectly willing to shoot the guilty myself, but just when did the US Constitution say that mind shattering treatment is permissibale to gather evidence to justify convicion? And since when were coerced and forced admissions allowed as evidence, in ANY US court- even military courts? We will NEVER know if the guy IS guilty of ANYTHING. He probably is, but that isn't supposed to be enough in America. Unless we ALL enjoy constitutional rights, none of us do. Does the Constitution mean what it says? Or, is it for everybody except Jose Padilla?
Answers:
Our government will never admit even the possibility that we've violated Padilla's rights. The gov't violated nearly every standard of legal treatment, in his case. Jose Padilla HAD to be found guilty, so he WAS found guilty. His conviction will probably be overturned eventually, but politically, a guilty verdict was required, so guilty he is. The sad thing is that NOBODY thinks that case was handled as ALL other criminal cases have to be handled, but have bought the old Communist standard. "The end justifies the means." Finding Padilla guilty was soooooo important- that ANYTHING was fine to get the verdict the gov't wanted.
Treason is a special case. I think he should be brought before a military court, found guilty and executed.
so, now that it has been confirmed that he is indeed guilty, are you still prepared to shoot him?
