How long are cops allowed to hold persoanl property as evidence?
Back in december my parents were murdered and the police took my brothers computer and my mothers computer in to check and see if they held anything that could help the case. It is now almost 8 months later and they still havent done anything with the computers, how long are they allowed to hold them under florida law?
Answers:
Until the case is closed. Then contact them and you will have go through request forms to get them back. Depending on what kind of evidence are held in them.
until the case is closed.
they are going to hold them until they have a suspect and it goes to trial them they should give them back or they will auction them call them and see if they are done with them.
I'm very sorry about your parents. Please accept my condolences.
In most cases, they have to keep the computers until the case is closed, which in murder cases especially, can be a very long time.
If you really need it back, you should contact the victim's services office at the local courthouse, they might be able to work something out where they can get all of the potentially useful information off of the computers and return them to you. You should at least file some kind of claims form so they will give it back to you when they're finished. That might be the best you can do under the circumstances.
Other than that, let them do their job, so they can find and punish the people who murdered your parents.
