Legal Notice?
We are a staffing company based out of NJ(LLC). We received a candidate from company A based out of KY for a position with my Client. The candidate however belonged to Company B. Company B for some reason did not want to work with Company A and approached us directly after the candidate was selected to work at our Client's and after the paperwork was sent to Company A.
Since company A was not able to deliver the candidate on time and we were answerable to our Client therefore we had to deal with Company B directly.We however offered to pay Company A a referal fee but Company A wanted the difference between his billing to us and Company B's billing to him.
We have not signed any contract nor have we sent an email saying that we would pay him the difference . There are some email exchanges about the candidates resume submission etc..
Now Company A has sent a legal notice to us saying if we dont pay him that money(less than 10,000) and an extra 5% late fee along with some damages
