If fireworks are illegal in the State of Pennsylvania, then why do retail stores such as?
Walmart, K-Mart, and local grocery store franchises sell them?
My children were playing with them and they were confiscated by the local authorities. Nothing major, just firecrackers, sparklers, snakes, which we purchased from these stores. Just wondering. Thanks.

Pennsylvannia has basically the same restrictions as West Virginia and Virginia. To put it simply, anything that cannot explode or leave the ground is ok. Items such as spray fountains,spin wheels,light strobe,crackling devices,smoke agents and sparklers all fall in these guidelines and thus are perfectly legal by the law to sell and purchase by anyone over 16 years of age typically.
So in other words the really fun items, like Roman Candles, Aerial Rockets, firecrackers, cannons, shells? Well forget it basically, best to travel into Ohio for that sort of thing due to their 72 hour non-resident transport law that is fun to abuse!
Now you said your children had firecrackers? This may be the reason they were confiscated. Depends on your definition of a firecracker. If it explodes? Yes it's a firecracker. If it doesn't explode ,but rather spins or crackles? The No it should have been perfectly legal!
One of the reasons the police MAY have confiscated your items was if the children were handling them. Yes I know its stupid. It is virtually IMPOSSIBLE to get injured on a snake and the only way a sparkler could hurt is if you hold the molten metal afterwards. This is just a prime example of , well pardon my language but it's what it is "A s s hole Cops"
Don't feel bad , WV is riddle with them all over the state. Im sorry that the police ruined your holiday however, especially your kids.

Some of the novelty items are legal over 18 I believe.
It is illegal for children under the legal age to have them.
