If a person is charged with conspiracy never goes to trial but pleads to a lesser charge, can they be tried?

It depends on the situation and if the charges were dismissed after he plead to the lesser charge. It's possible that if new evidence is located, the person might be charged with conspiracy anyway.


If it is national security and the person is charged with conspiracy they can not plead down to a lesser charge. Only in civil matters can you plead to a lesser crime to escape the more dire charges.
