Does this violate any laws?
I want to sell dresses at a boutique or on ebay. The dresses would be store bought but I'd then add things too it or change the entire design etc, just using the dess as the base part (adding to or taking away i.e. length or adding lace or fake flowers) since I don't know how to sew from scratch. Does this violate any laws?
Answers:
No, it doesn't violate any laws, as long as you are advertising the dress as embellished and not as completely designed by you.
Not to my knowledge. Many attorneys will give you a free consultation, I'd try that!
As long as you say that it isn't new and has been tampered with. Then you'll be fine.
I would call a boutique and ask them.. Selling it on ebay I would say no... Unless your selling at as your product in whole but if you say the maker and you just added stuff or changed the design a little I don't see any laws broken... If you call a lawyers office and just ask them it shouldn't cost you anything to do that... Just to be on the safe side... Or email them your question.
No. You would have to put in your own label, however.
that sounds like something my eight year old daughter would enjoy doing!
no of course not , ure ok
no and learn to sew. people don't care what you do to the dress as long as you pay for it
uhh ya i think so but im not sure
Probably not. Once you acquire the dress, its yours to do with pretty much as you please including altering or reselling.
To b on the safe side, you probably should not represent that you made the entire dress, just tell the truth, that you altered or in some other way enhanced the dress.
I don't think so, except I think you would have to remove the labels from the dress, because then it would no longer be their own.
No, its yours, you bought it. You are going to redesign it, then sell it. Good luck!
I don't think it breaks any laws as long as you say in the listing that you altered the the dress.
you have something to sell i see no difference just don't claim the design, unless the company or original designer is outdated
I'm not sure about a boutique but to sell items on ebay or other sites is like a yard sale you can sell any thing
I don't think so, you bought it legally from the company, and aren't advertising it like you are the company.
yes you cant tamper with original products if its tradmarked. Thats against the law!!!!
Yes it's illegal.
Not in theory. You can make a dress from their patterns or a similar style. Companies make knock-offs all the time, but they start from scratch.
But you are buying their actual product, changing it, then selling it as your own under your own store and product line.
That's Illegal.
No, just take the tags off. You can't say it is a Ralph Lauren or whatever if you redesigned it.
The reverse is fraud. That is, taking your work and representing it as someone else's. But buying someone else's work (they get the money they would get anyway) and changing it and putting your name on it, no one is being deceived or denied money they should have gotten. If you think about it almost everything we buy is that way (is there a label on a dress for the cotton grower, or the textile mill etc. No).
the only way it would be illegal is if you were going to market them as your own designs.
