Is it possible to have a sentencing postponed?

what I mean is...Say you accept a plea to plead guilty to a misdemeanor. Can you make some sort of deal to have the guilty plea entered at a later date? Say, you offer to do community service so you can keep your record clean for the upcoming months?

It would be highly unusual for a second deal to be reached - so if you want to try that sort of approach, assuming that type of deal is something with which the local prosecutor might and/or could agree, you should make sure that your attorney includes the deferred plea in the initial negotiation. Once you've accepted a plea deal, it's unlikely to be reopened.

The critical point is that if you don't have an attorney representing you and nailing down the details of your plea deal, you are likely to make yet another mistake that can hurt you.


It's called Diversion. Whether or no you're eligible for it depends on the charges and any priors you might have. Talk to your attorney about it. or if you don't have an attorney, ask the judge about it.
