Habitual traffic offender??
i just got a summons to court to show cause why i should not be considered a habitual traffic offender. my last offense was 2 years ago, why am being summoned now? if the judge decides i am a habitual offender does that mean i get an additional charge? or just get my license revoked?
Answers:
When you got your last offense, how many had you gotten before that? Have you gotten any kind of non-moving violations, like parking tickets? Even if you haven't gotten any tickets since then, have you been pulled over and let go with a warning? Something else has to be up (or maybe there was such a backlog in traffic court, they just got around to evaluating your driving record.)
It ALL depends on your state. You have to include those things when you ask questions like these hun. I can't tell you without knowing that.
Go to court to find out. Maybe someone used your name when they were driving and didnt have id. It does happen.
yif the judge decides-bring proof of every thing you are doing to correct this problem and he/she might not suspend/revoke ,go for suspention!
Call the Clerk of Court at the courthouse that you are scheduled to appear in and ask them why and how you were singled out for this.
EXPLAIN to the court how you have not had any violations in two years and that you are sincerely trying to mend your ways, and mean it. perhaps seek other guideance or even legal help from an APPROPRIATE AND EXPERIENCED lawyer on this.
It is very likely that yes, habitual offender is another seperate charge, possibly carrying a one year jail term and a $ 10,000 fine or both, plus you will still have to answer any and all other charges against you. JUST AINT A BIT OF TELLIN WHAT DA JUDGE IS GONNA DO, so you better impress him in a favorable light
It all depends on the type of offenses I would say..
