Answers:
Ask your telco for a copy of the terms and conditions of your cap plan. Some services and products aren't included in your cap, like premium SMS for example. You will find that usually only basic things like calls, regular SMS and MMS are included in your cap. You will have to pay your bill otherwise your telco may bar your service.
pay it then dispute. pay it so you dont lose your phone.
Have you actually called the company and asked them? Have you looked at your contract for the phone or any other paperwork concerning it?
Hey no one can get their head around any of the phone companies billing systems. There billing system is like a gob of yarn only they can figure it out. That why they write the contracts in small print and very long. If anyone can screw up a person brain its the phone companies.
It sounds like to me the following:
when you got to the 33 dollars and then they add the 11 dollars that sent it over 44 with the other charges and the penalty. Remember there is nothing in their contract that is straight forward.
