What is the maximum penalty for drink driving in UK?

I got caught about a month ago and have to go to court for this. This is my first time done for drink driving but I have just come off license from a 12 month sentence for ABH.

I know there is an automatic ban and a fine and you can get jail time but I'm hoping it won't come to that as I just can't imagine having to go back there again now that I'm getting my life back together.

If your were not too much over the limit you could get the basic 12 months! then take an alcohol awareness course and get 3 months knocked of the ban!
If you're at the Magistrates' Court, the maximum penalty they can impose is 6 months' custody.

More common for drink driving is a Community Order, often comprising Unpaid Work and probation Supervision, maybe if your breath alcohol reading was high enough also the Drink Impaired Drivers Programme. Some people are lucky and only receive a fine.

What sentence you get will depend on your breath alcohol reading, whether you were involved in an accident, and whether you have a problem with alcohol You don't need me to tell you that the Magistrates won't be greatly impressed that you've only just finished a licence and you've offended again, however I'm assuming this is your first drink/drive.
well your looking at a ban as you know, anything from 6 months up.

now if you was on the road legal , stopped when requested to , and depending how much you was over the limit i would say 12 month ban, if your out a work your getting CS for a good few hours on top.

go guilt when ask to my the judge tell him your sorry and they was no excuse for what you did, he'll take that into account and go lighter on you, lets face it they have heard every **** and bull story anyone could think of as to why they was driving pissed up.

judge will just slap you and give you the run of the mill do it again and you'll do porridge
its usually between 12-18 months ban and a fine... you can take a drink driving course which reduces your ban by 3 months and will help lower insurance quotes when you've regained your licence.

i would have thought that the drink driving and ABH are 2 separate offences so although it may be brought up, i don't think you would incur a custodial sentence. it might just mean a longer ban.

You can go to jail if you weren't insured and you injured/killed someone. I'm guessing you didn't and you were lucky. They should have kept you in longer for ABH. That's nasty and there's no excuse for violence. You obviously think the justice system is a walkover seeing as you committed another offence. You are a danger to society obviously. Sorry but I already think this country is too soft on criminals and you did the crime so pay the consequences. No-one forced a drink down your throat.
"Getting your life back together" You might have torn some innocent person's life apart, chum! There is absolutely NO excuse for drink driving. It's time there was a total ban on alcohol and driving, because there is NO safe limit.

You will certainly get the mandatory ban. You will most likely get a big fine. Expect to go to jail for repeat drink drive offences.

Sorry to have to say, if convicted you face a maximum penalty of up to six months in jail or a fine of £5,000 or both as well as disqualification for at least a year. In most parts of the UK repeat offenders and those with very high alcohol readings are likely to receive a jail sentence. But apart from prison more constructive sentences like community service or probation with an alcohol education programme are now quite common if the offender's alcohol level is high but not extreme. Purplepadma is spot on, though you should expect the worst given that you committed your offence while on license and if you didn't take your ART programme seriously then you won't get DID.

So, you go and hurt someone, obviousy with total disregard, making you an idiot.

Then you go drinking and driving, again knowing you could seriously hurt someone, possibly kill them, and yu want to know how much time you will get.

Be assured, and when you tell the Judge, as you have told us here, that you have just got your life back together, he will quiz this, especially in light of the fact that drinking and driving could result in someone else never getting their life back.

Bow your head, take the ban, whichj I hope is for at least three years, and a possibe 6 months to emsure you have learned the lesson.

The Judge will, rightly, arrive at the conclusionthat you do not learn quickly, and perhaps 6 months will give you ample time to reflect on being an ar*se hole.
