Double Murder?
Why is it that when someone murders a pregnant woman it counts as double murder?
According to the law, a fetus isn't a human being, I believe (Hence abortions) So why is it double and not single murder?
Answers:
Simple. The choice to have an abortion or not rest with (and only with ) the woman. The killer does not get to exercise that choice.
Not in Alabama, Alaska, Colorado, Connecticut, Delaware, Hawaii, Kentucky, Maine, Maryland, Montana, New Jersey, Oregon, Texas, Vermont, West Virginia, and Wyoming it's not.
It's a living breathing person. It has a heart that beats, blood pumping the works. Once you are expecting you are eatting, walking etc for two. So if you going to kill a pregnant lady well its not just her life you end!
Many states determine that if the fetus could have been born and had a reasonable chance of survival on its own that they will charge someone with murder.
In those places, a 2-month old fetus wouldn't count, but an 8-month old one would (many women deliver their babies early and they survive).
