Well, if you mean, what happens to fathers who don't pay child support, then in most states (not sure about west virginia) the following occurs in an attempt to collect child support:
1) The child's legal guardian (usually the mother) will obtain an attorney and petition the family court for a child support award (that is if paternity is not at issue - if it is, your going to have to petition for a determination of paternity).
2) Once, the court has made an award (it is usually around 20% of his income), the father is then given some time period for compliance (the award usually includes back child support so he will have x days/months to pay the back support if he is not financially able to at the time of the award)
3) If he does not pay the support, you and your lawyer will petition the court for child support enforcement action - which can be done in any state your child's father is in, even if he has left the state the award is from - thanks to the uniform family support and enforcement act.
4) After the judge places an order for enforcement, if the father has a job, his wages will be garnished, if he does not he will most likely be made to find a job - which will be monitored by the court. The court may also suspend his driver's license (except for being able to drive to work) until he is up to date with support payments.
5) If the father has the financial means to pay the support at the time the enforcement is ordered and he refuses, he will be held in contempt of court and place in jail until a time he agrees to comply.
Their mothers sue for child support.
