Child support question?
ok here is a scenario.. man has a one night stand with a woman, she gets pregnant and has his child but he doesnt finds out till 8 yrs later..
does he still owes the child support for those 8 years?
note she never contested or tried to contact the father either.

no, because she never requested or even sued you for child support. If this matter did go to trial, the judge would say why after 8 years is the mother finally asking for child support, and why the mother never asked you to be involved in the child's life. The judge would not make you pay the child support, but he probably would advise you to, for the betterment of the child. You would probably also get part custody, and thecourt would look down upon the mother.
Unfortunately he does. I would be sure to have a DNA test.
I would say no, but I don't know the law that well. Common sense would say that if she never tried to contact the man or contest anything, he doesn't owe her for those 8 years.
But he should pay from the time he found out.

hmm this is a tough one...there is a case going on right now if fl for a guy that has to pay over $10,000 for a child that turns out isnt his and they are still making him pay bc he missed the time frame to challenge the paternity. however if you were not there for the birth and didnt sign the birth cert. you might have some leverage. she would need to prove she contacted you im sure...and this person better keep notes on all convos/dates/emails etc.
It probably depends on the state. I had a friend who the same thing happened but after 5 years. the only just started paying when they found out and they dont have to pay back child support. - in VA.
If she had a one night stand with you it probably wasn't the first time for her, get a DNA test, if it is your child take it away from her for being a bad mother, then make her pay you child support!

In fact, without the state the only answer you can receive is "It depends on the state" and the reason is, many states allow RETROACTIVE child support to be assessed either from the time of the live birth or to the filing of the support order.
So, before I go further, in what state was the child born and does the mother and child still live in that state or, if not, where now?
I dont think he would owe child support for a child he didnt even know existed. There would need to be DNA tests done, and once they confirm that this is the father then I would think then he would have to pay child support. Who signed the bith certificate. If another man did then he actually has to pay the child support he took responsibility for the child at the time of birth. I dont know if you are the mother of father but why would this question come up when the child is 8 wouldnt you if you are the mother have wondered about the support before now? If you are the father I would get a lawyer because this seems to be a complicated situation. Good luck. I hope this helps.
