You can put a fence ON the property line.

Putting the fence beyond the property line and leaving it there without contest from the neighbors or the city, makes all the property within the fence yours after 7 years (homestead "squatters" act).


This will be up to your local municipality. When you apply for a fence permit, it will indicate how far it must be set back from the road. Usually, in the back yard, as long as your neighbor doesn't have a fence along his/her property line, you can go all the way to your property line. The municipality my require a certain amount of feet between fences for safety purposes.

In my town you need a variance (public hearing, etc) to erect any "structure" within 50 feet of the property line, but you do not need a building permit for anything other than a new "building" (walls with a roof).

Warrior's answer overlooks the possibility that the neighbors could also give you written permission to build a fence on their side of the line and it would not become "squatting" or adverse possession until 7 years after permission was revoked (in writing).
