If someone is fired because he "suspected" that another employee was stealing and didn't tell, can he fight it
Walgreens is notorious for paranoid loss prevention practices. Someone I know was fired because he "suspected" that another employee was stealing, but he had no conclusive evidence. Snitching without evidence is not conducive to teamwork, but keeping quiet is almost as bad as stealing. Where do you draw the line? Would this former employee have a case to get his job back?

No he dosen't. He should have gone to his supervisor and said.. Look I don't have any conclusive evidence but I think that so and so could possibly be stealing. I don't want to confront him because I don't know for sure but just thought you should know about it. His supervisor would probably then ask what made him think so and would start watching that person more closely. I am in a position where I must hire alot of people and if I had someone working for me that "suspected but didn't say anything" I would wonder about that persons concern for my company and his moral character. People who steal hurt everyone! Including the consumer(businesses have to charge more to make up for what is stolen) and fellow employees because if the company is losing money you're never gonna get that raise you worked so hard for. Never should anyone think that a minimum wage job dosen't mean anything except movie money, It builds character and teaches us about the real world so that when you do get a better paying job you will have learned much and appreciate more. Also, It is a well known fact that businesses like Walgreens or any other store loses much more through employee theft than from customer theft so I don't think they are being paranoid just realists.
No...sorry.as an at will employee they can fire him for any reason other than discrimination. A court cannot order them to hire him back but can award damages if he has any for any possible defamation ...if Walgreens claimed he stole or helped steal...otherwise he is out of luck.
Probably not. Most states operate under something called employment-at-will. Basically this means that anyone can be fired at anytime without explanation.
If Walgreens is that suspicious, and that's why they fired your friend, I doubt if there's any way he would get hired back. And I doubt he could sue for wrongful dismissal.
Except Montana all states are "at will" states this means an employer may terminate you at anytime for any reason. Far as LP goes they can be very abusive and often break their own polices. Check this website for More information on LP and LP practices
i know someone with the exact same case...and he's still fightin to get his job back. it's been 2 years since he was fired and still struggling with the case. Anyway, it is really difficult to put a demarcation on this issue..it would be fighting with out any evidence.
