Can someone be jailed as an adult for a class six felony commited as a minor?

I have a client In VA who says she commited a crime that is considered a class six felony for a 17 year old. Now she is 22 and wants to know if she can be charged for that crime.

Yes, as the statute of limitations hasn't expired for the crime.

If arrested she would probably simply be charged and be subject to the lesser penalties any minor would.

And I'm Susan remember...there are more than 1 state in the Union. Different states have different laws...and while your state may only have 3 classes for Felonies...some states have multiple levels...and some states even gasp.letter them...example in North Carolina you can be convicted of a F class felony...well beyond level 3.

If the statute of limitations hasn't run out yet, then yes. She would be charged and sentenced as a 17-year-old regardless of her current age, but in most places, a 17-year-old would be arraigned in criminal court anyway so it would make very little difference. For crimes committed by a minor who would be tried in family court when the crime was committed, they would still be tried in juvenile court even if they were charged with the crime several years later, as an adult.
