The father of my unborn child is going to Iraq. If paternity isnt established and he dies, can I file for SS?
The father is in the Navy reserve and will be out of the service when he comes back. He refuses to support the baby until paternity is established. When he comes back the baby will be three months old. If he dies over there, is there a way for me to still establish paternity? Everyone in the military I know tells me that the military will not use the DNA samples that they keep for this purpose.

Put his name on the Birth Cert. That way if Dad dies in Iraq you will be able to get the benifits for your baby. Dont bother trying to take daddy dearest to court while he is away for military. The soldiers and sailors act prohibits any deployed servicemember from having legal action taken against them. Sorry to say, but your screwed on child support untill he comes back.
Another thought, he may have something put into his will about not letting your baby have any dependent rights untill paternity is established, so be prepaired for that also.

Nice guy. I hope you aren't planning to marry this imbecile who obviously thinks you've been slutting around on him. Here's what I advise: when the baby is born, go file a claim for child support at your Domestic Relations office. (From the date you file, he will owe support.) The father may demand a blood test or there can be a court hearing to determine paternity. If he is unable to participate in this trial due to being overseas in the military, whomever is legally responsible for his stuff while he is gone may be able to sit in on his behalf during the hearing (not sure, check with a local lawyer). In any essence, if, during this time, the father is killed, and there is no way to disprove your claim of paternity, then your child should be entitled to survivor's benefits and so on.

If he thinks that little about a baby that might be his why would you wont anything to do with him anyway. Plus is that why you had the baby so you can milk money out of someone?

First the Navy will not let their DNA information database be released to the public.
Second the Father has to admit paternity and file the proper paperwork for you to get any support. Forcing the issue, with the sailor deployed will be impossible.
You will not collect anything until paternity is established, no matter what you file. The USN is not obliged to release any DNA samples to anyone. You will need to have a court hearing, with him present to gain anything. Obviously, he has reason to doubt the paternity.
