Same-Sex Marriage?
If a same-sex couple married in MA but reside in NY? Will the license still count? And yes I know it is not recognized in ny but we will still be domestic partners here in NY i just want to legally marry my girlfriend I guess..

As far as I understand it yes. If you are married in MA and move to NY that doesn't recognize same-sex marriages your marriage is still legally recognized by the state of New York. However the state and federal government do not have to provide you with marriage or federal benefits related to a legal union.
Yes, the license still counts. Licenses hold across state lines, country lines, etc.

No seeing New York does not have a domestic partnership law that recognizes same-sex partnerships. You will be still married in MA, but you will not have the same legal status as heterosexual couples in NY.
You might want to move to New Jersey or Connecticut because they do recognize same sex domestic partnerships.
the defense of marriage act actually makes it so that if you're married in MA as a same-sex couple? other states don't have to recognize your marriage.
it hasn't been challenged to my knowledge, but it's not likely to change any time soon.
I think the license gives credibility based on the credibility you put into it. If you want to get married in MA I say do it, even if NY wont honor it the same way. Hopefully its just a matter of time before the marriage would be wholly applied in NY.

Yes, they will have to recognize the union regadless if it isn't allowed in NY. It's no different to that of sex gender changes (operations), they recognize the person as another sexual gender "after" doing it, that is why some men (or use to be men) go into womens restroom legally. Regardless, if it was done in another country, when it was illegal to do it in the USA. They came back transformed into another person or sex gender I should say.

In my opinion the license is just a pacifier and you should not attach that much value to it. Isn't it recognition and acceptance that you are really after? Just live your life to the fullest now because when the Muslims take over, you will be publicly executed
Right now MA has said it will not marry same-sex partners that do not reside, so if a license is issued to two NY by accident or fraud, it will be void.
A more interesting question is 2 MA residents get married and then move into NY is the license still valid?
At the moment that is an unsettled point of law. The governor of NY has indicated that he would recognize it. However, the first time a homosexual marriage is either recognized or not recognized it will almost certainly wind up in court.
I have heard several atty predict that the court of appeals will rule that it will be recognized under the contracts clause. But until the court rules on the case, it will be an unsettled point of law.
