Is it really statutory rape if its less than 2 years of an age difference?

I am 16 and I have been with my boyfriend for almost a year (he is 17...and has been our entire relationship) having that been said his birthday is coming up and he was becoming somewhat worried that he will be charged with statutory rape if we continue to have sex. I'm a little confused about this myself because i am about to turn 17 in less than 4 months after he turns 18...so is that really statutory rape? We are less than a year and a half apart ( 1 year and 4 months to be exact)...and if it is does that mean it is illegal for an 18 year old to have sex with a 17 year old (even if they turn 18 the same year...)? I Live In the state of Missouri and I have looked this up everywhere and I really don't understand...(A detailed yes or a no would be more appreciated than a website link)

It is not and would not be statutory rape at any point, but he is currently committing child molestation. For statutory rape, the person must be 21 or over and the victim under 17 or the victim under 14. However, for child molestation (which involves any sexual touching), there is no minimum limit for the agressor's age - it is illegal for any person to have sexual contact with a child under 17. Once you turn 17, there will be no crime involved, since that is the age of consent in your state.


I think as long as your parents don't complain then the authorities would never know. If anything all the two of you have to do is deny that you ever had sex and you'll be fine. Just take birth control, try to wait 'til you guys are established before you have little ones. LOL

I'm just guessing I'm not a lawyer and I don't know how it works.
In Missouri, 2nd degree statutory rape is a person 21 or older having sex with someone less than 17. (First degree is the party is under 14.)
Legal Age of Consent in Missouri is 17. So as soon as you turn 17, everything is legal.

But before that, while he is 18 and you are still 16, that is technically against the law.

anyway... an 18yo in missouri can have sex with a 17yo legally... as long as its consentual of course.
In Missouri, First-degree statutory rape to have sexual intercourse with another person who is less than fourteen years old, and Second-degree statutory rape for someone at least age 21 to have sexual intercourse with someone who is less than age 17.

Looks like no one's going to jail, but remember to wrap it up. Just because your parents don't mind you guys dating doesn't mean they want to be grandparents yet.
