I need help with a custody issue, PLEASE!!?
I have sole custody of my daughter in wisconsin. I have now lived in florida for over 2yrs. I just found out that her father had sex with his step daughter. he knows a lot of people in fla., so if he comes down here he can live and work very easily. I called the hillsborough county clerks office. they told me i can transfer custody from wisconsin to florida, but it would be an almost $400.00 filling fee. I am on disability and am not getting chils upport from this jerk.is there a way to waive filing fees? if he does come here can he take her?(since i don't have custody here)

If wisc court granted you sole custody, the only court that can change the custody arriagement is a wisc court. If you ex-files in Fla, just being the Wisc order to court say, "motion to dismiss on the grounds of lack of jursidiction" The reason why YOU might want to transfer jursidiction to Fla is right now your ex can start filing motions in Wisc. And you would be required to appear. Which could get expensive travel-wise.
You need to get in touch with your local lega aid office they should be able to help you and let you know if he can take her or not but I do not see way he could. I mean my mom had custody of me when she left my dad and we moved she never had to change anything and considering that my father was a child molester that would have been relly screwed up if he could come and take me. I believe you are over worrying yourself but just to be safe contact your legal aid office and good luck!
