I got fired today for bringing booze to work. Is this grievable?

Basically my work is super boring. There's like 6 people, and it's graveyard shift. And no one ever talks or anything during break so I thought I'd try to liven things up by bringing a pack of Coronas in yesterday. I brought them in and put them in the large fridge we have in the lunchroom because I didn't want them to get cold and I intended to share them after work. Anyways, one of the employees found them and got a little drunk during working hours, and the supervisor asked who brought them in and she said me. So the supervisor told me that was completely unacceptable and not to come in tomorrow (being today). Today I got a call from my HR lady saying Im being terminated and to come in for a final interview tomorrow. But get this, the person who actually got drunk ISN'T GETTING IN TROUBLE AT ALL!! So do I have a case if I take this to a tribunal or something?


p.s. my job is unionized.

I doubt it seriously. And if the person that got drunk was underage, you could be held responsible.

I'm sure there's something in your SOP somewhere that says "no alcoholic beverages on premises". It was a bad move on your part - you can't blame anyone but yourself.

I think it's pretty lame that the person who actually consumed alcohol on the job didn't get fired, too -- you both should have been fired. It's pretty clearly against the rules for pretty much every job there is.

You might have a case against them for not disciplining or firing the person who drank, but I doubt you would get your job back or win any kind of wrongful termination suit. You were wrong.

I have several responses:

1. I think it depends on whether the company has a rule against bring alcohol into the building. If it does, and you broke that rule, then they probably can fire you.
2. Ask your union rep.
3. I do not understand why you put something in the fridge because you did not want it to get cold. You should put something in the fridge if you do want it to get cold or you do not want it to get warm.
4. If the person who drank them did not know that they were alcholic, then it is not her fault that she got drunk and is your fault for not telling her (unless it was obvious).

You could probably go to rehab or something,you say your job is unionized,talk to your steward.
I'm sure that there's something in the fine print that says you aren't allowed to bring alcohol onto the property, so you're out of luck on that one. They could probably have gotten you for passing it out in the parking lot after hours, too. I'd recommend meeting somewhere after work from now on.

As far as someone filching your beer during working hours, I'm amazed that they aren't tagging her for being intoxicated on the clock. You MIGHT be able to get an action against her for theft, but it's not too surprising that no-one wants to be in the middle of determining if she got the beer with or without your permission, that's your word against hers, and totally unprovable. Either way, it's not going to get your job back.
Call your union rep regarding the incident, but tell the whole and complete truth.

To me, it sounds like you aren't telling the whole story OR your employer has been wanting to get rid of you for some time and is using this incident as a reason to avoid unemployment benefits (assuming that it was against the rules to bring alcohol on the premises).
