I have charges pending for a felony. Will my job find out through a background check?
I just got hired by a restaurant, and I have a pending felony charge against me from December. The restaurant wants to do a background check on me before I'm officially hired. Can they find out about a pending case that I haven't been charged for through a background check?

No they cannot find out on a pending case as you may or may not be found guilty. You have been charged with a felony but without a conviction there is nothing to be found. Think of it this way what would happen if a person were charged with an offense and this could been seen on a background check and it cost them an opportunity to get a job then they were found not guilty. Isn't fair is it? The law is geared to be as fair as it can be. It is not perfect, but that would be a huge shortcoming/over site in the law effecting every person who was charged with an offense who happened to be seeking employment or changing employment at the time. What if it took years to go to trial. You follow me? As long as they did not ask about any pending charges then you have answered the question truthfully.
Yes, it is possible. it depends on the 'type' of background check they do.and also how the cases are reported in your jurisdiction.
Be prepared they they will find out.and no you won't be able to collect unemployment if they do not hire you.

Depends on what agency does the check. If they run through the state, yes, the arrest will show up. If they run through a background agency, probably not. Make sure you answer the questions honestly on the application - if they asked if you have any convictions you can say no. If they asked if you have ever been arrested, then you have to disclose it, or you'll be subject to giving false information to get the job.
only way is if you have been convicted for thi feloney. be warned if you make a plea bargin make sure your lawyer,gets it in a motion with the court,in writing to a lesser charge,or you may not be able to keep this feloney off you record.
