Why is it legal to be a porn star but not a prostitute?
i mean whats the difference besides one is being video taped, so if i were to solicit a prostitute(which i never would) and said i wanted to video tape it b4 the act ever occured, would that be legal, the only difference i can see is the the gov. can effectively tax pornograpghy, but not prostitution, so is that why ones legal and the other isnt

Its a matter of public health and safety. Sure, the prostitutes in legal houses in Nevada are checked regularly; but there is no way to set up licensing and testing for every prostitute in the U.S.A. Too many people start the career each day. Not enough people use condoms and other safe-sex practices to prevent the spread of disease.
Porn stars are usually tested just like the legal prostitutes and the risk factors are normally contained within the actors. Those involved with people outside the business assume the outsiders know the risks involved. Pro-Am features (Star X having sex with 500 strangers) require the armatures to sign consent/releases and be checked for HIV and AIDS before participating.

It could be that both people (or 3 or 4 or 10...) are all being paid as performers by a third party.
BECAUSE PORN FILMS ARE PROTECTED BY THE CONSTITUTION UNDER FREE SPEECH..PROSTITION IS NOT FREE SPEECH AND THEREFORE NOT PROTECTED.

it's legal to sell the porn, but it is actually illegal to film it and produce it. Just about all porn films are shot in secret locations.
another loophole is that they aren't getting paid for the sex, they are getting paid for the sale of the video.

It's hard to catch someone making a movie cause they skip around and film in different places whereas a prostitute will stand on the same street corner night after night and they are easy to bust. Oh and the porn flicks are against the law in most states.

Thats a great question. Honestly there is no difference, and to these people who say "free speech", free spech was made so people could speak out about things they disagreed with, no so people could be payed to have sex on camera. This is a reflection of our culture today, that being a porn star is legal.

ANY question about WHY any law is written as it is has the same answer. That is how the law is written. Attorneys and legislators will give other reasons, but in the final analysis, that is the only correct answer. Taxes are NOT the issue. Many governments DO effectively tax prostitution.
Do you know I don't have an answer...but I thought it was an excellent question and one that needs asking in higher circles. They both should be the same really, they are doing the same thing.
