What is the term for when someone sues you or takes you to court just to get back at you for suing them?

There is a legal term for this I just cant remember it.
This word means that if the judge finds that the plaintiff is suing as revenge then the case is dismissed.

There are several terms for this. Malicious prosecution and abuse of process are both correct. A more recent term is a SLAPP lawsuit, which means "strategic lawsuit against public participation." SLAPP suits are illegal in my state by legislation. For more information on SLAPP suits, check Wikipedia. They have a good explanation of SLAPP suits.

Malicious prosecution -- or wrongful prosecution.

Also sometimes called harassment.
i know a return suit for being sued is called a countersuit.

but i don't think it might be the word you are looking for since coutersuits are not automatically dismissed.
