Can I do this to roomate's Security Deposit?
He used to smoke weed in my condo, causing another roomate to leave. Can I legally take money out of his Security Deposit?
If yes, would I legally take it because he was using drugs or would it be because of him being the cause of another roomate's leave?
Answers:
Why do you have your room mate's security deposit? Wouldn't the landlord have it?
No !
Better ask a lawyer that one. I would say yes if he was the cause of the room mate leaving and causing you a finical burden. The thing is if he was using weed and you knew about it you should have told him to leave and given him is deposit back.
Wait, are you the landlord or the roommate?
If you're the landlord, and he broke the rules by smoking weed, then yes, you can. If you're the roommate, then you can take money from his deposit to reimburse yourself for the portion of HIS rent that you had to pay since he moved out.
NO you cannot use a deposit in that way. A security deposit is for the cost of rent or any damages to the property period. You do not have the right to keep the money just because he was a jerk.
