Self defence (i am under age)?
first of all i live in vancouver,canada just in case you need to know. I am 13 years old and a few days ago my mom's ex boyfriend called me and asked if i wanted to go out for coffee with him (he is 50+ years old). And this wasnt the first time he called about something like that, a while back when my mom and him were dating he asked me to send him my picture but i didnt. And so now, i blocked his number so he cant call me but, im scared that he might stalk me at school or when im out. lets say i was walking home one day from school and i walk somewhere where no one can hear or see me, and he is there and he grabs my arm and tells me to follow him, and i said "No, go away." But he still tries to get me to follow him, and i happen to have a pocket knife on me so if he touchs me again and i pulled out the knife and stabbed him in the stomach or if i killed him or harmed him what would happen to me? would i get charged for death? My brother told me i wouldnt because it was self defence..

Call the police and report it to them, I'm sure they would like to have a talk with this guy.
Generally speaking, if somebody grabs you and won't let you leave, then you have the right to use the minimum amount of force that it takes in order to make him let go so you can escape. In other words, if you could disable somebody with a punch to the nose or a kick to the beans, then don't use a knife or a gun. Using a knife is automatically considered deadly force no matter how small it is or where you stab somebody with it, so you shouldn't use one unless your attacker is vastly larger than you. If an adult does try to forcibly abduct a minor, I would certainly think that person would be justified in using a knife. But it's really better if you would report your concerns to the police and if you can get some friends to go with you to avoid walking home alone.
With the age difference and you being an "innocent kid", you probably would get off on self defense. But why let it get that far? Tell your mom what's going on and see what she wants to do about it. She may want to file for a restraining order(or whatever it's called in Canada.) Since he's an ex, it shouldn't be a problem. If for some reason she doesn't want to do anything, then go to your school counselor for help.
I think you should talk to some one. tell them what you feel and your fears. Do not pull a knife you can and will be charged with a weapons offence. Get help

You have the right to be safe in your person. You have a right to be free from others trying to force their will on you.
That said, you would be hard pressed to prove you were attacked, unless you were injured, or in peril.
I would report the activities of this person to the authorities, and get a restraint order.
The laws will protect you, and since you asked about harming another, a prosecutor could argue that you stabbed him with intent.
Means you already planned it.
You need to report this guy to your school counselor immediately! Why not your mother? Well, she should know too but a lot of women are in denial about such things and she may inadvertently make you feel guilty about ratting on him!

I`m not a lawyer , but it seems to me that in a case like that , there would be at least some element of self defence .
You also must remember that in "Kanaduh" , you do NOT have the right to defend yourself like you do in any other country ! The judicial swine here decided long ago this was in our best interests .. LOL .
Personally , I would disregard the "self defence" laws and slice this guy`s weenie off if he tried that with me .....
"Self-defense" would apply only if someone is trying to KILL you, and even then sometimes there is a lot of gray area.
How about calling the police on this guy? If he's stalking you, that's against the law. You should get a restraining order against him. That makes a lot more sense than plotting to kill him if he doesn't leave you alone.
You could definitely go to jail if you assault him, even if it's in response to him stalking you. Report him to the authorities now!
According to your description of the incident, the presentation of self defence in this case, is not present...yet as you told that he is stalking you and then when you happen to pass by a dark and isolated place, he happens to be there and grab you by the arm and pull you and told you to follow him, still grabbing you by the arm. Dragging you by now. And since you happen to have a knife by your purse or something pull it out and stab him, you are therefore be charge with ATTEMPTED HOMICIDE if he is happen to survive the stab wound and was only hospitalised, but if he dies, you are charge with HOMICIDE. Because the story you told here there is no sufficient evidence of eminent threat yet in your life, he is just dragging you on some isolated place where in he would definitely do his evil deeds. Unless his plan is clearly show what he would do then that is the right thing to bring out your knife and stab him but not before the threat. You have to give the impression that you reason out with the suspect or plead "please, don't do it." and have to waggle with him or have to scratch his face if he attempted to remove your clothes in order to have the chance of raping you.
You're brother is wrong. He is leading you on a different version of your story. Remember trust your instinct, if danger is present then that is the best time to react on any given circumstances. Stabbing him while he is grabbing you would only complicate your case, he might reverse the situation that you intent to kill him while he is just passing by that corner of the road. See what I mean, it will be your word against his word.
