1st degree 2nd degree assault?
What is the difference between 1st degree 2nd degree assault? Which is worse
Answers:
Usually 1st degree is the worse charge in any case. I don't know which state you are in, as they are all a little different. The circumstances involved in the offense will dictate the charge. It sounds like the difference will be the severity of injuries, whether or not a weapon was used, and if it was committed in conjunction with another offense, particularly another felony.
Do a search for your states penal code, and look in the crimes against persons section. Most can be found online.
The difference between first degree and second degree is how the crime is committed, meaning, for first degree to be administered, one must show that you had intent of harming someone. An example would be if someone punched your brother and you got all mad and went out for revenge, this shows you had intent and on the other hand, second degree falls if you were negligent in committing this act. An example of this would be, you are holding a beer bottle, and someone hits you in the back unintentionally, you do not know of its intention but you swing around and hit the person with the beer bottle. You never had intent, but you were negligent in committing the crime.
First degree is always worse, then second.
