Can I legally change my daughters last name to my married name?
how do i go about doing that.
her birth father has never been in the picture and she is 4 y/o. hes not on birth certificate and wants nothing to do with her. i have been with my husband since she was about 14 months.
he is going to adopt her in the future but we gotta wait till we have the $$$$$
she starts school soon and she wants her daddys last name just like all the rest of us.

When my sister signed my neice up for school she just signed her up as the last name as her husbands last name (the scenario was the same as your is now. ) Till this day (she is 26) she uses that last name for everything she does. Needless to say her birth certificate and her drivers license both have different names.
I don't know how, but I know that it's possible.
i'm not sure about this ...but i think you have to go to a court of some kind.

You didn’t say what state you live in, so speaking very generally...at 4 it’s very unlikely that you can just amend the birth certificate (you probably could if she was just a few months old). You'll probably have to go to court. If bio-dad is legal Dad (and if he’s been ordered by the court to pay child support, then he is), you will need his permission or permission from a judge. If it boils down to having to get a judge’s permission, then I wouldn’t bank on it. Her wanting the same last name as the rest of the family is likely not going to be reason enough for a judge to approve the name change without Dad's consent. There are tens of thousands of kids in the US who don’t have the same last name as the rest of their family and there is no stigma attached to that.
Of course, once Step-Dad adopts her, then her name will be changed to his.
