I want to sue a person for calling me out of name even after asking that person to stop?
The name is very offensive and it happens at work where more people are starting to do it, so I wont to stop it before it gets out of control by making an example out of someone.

What I mean is. If they're calling you an idiot, for example, can you be sure they won't show up in court with an excellent attorney and expert witnesses to prove that you are in fact an idiot.
It sounds silly, but it's only defamation if it's not true. So, if someone calls you a jerk and you plan on suing them, then you better hope there's no one you've ever been rude to that's willing to testify against you.

You can certainly sue people for anything these days.
File a complaint at your job and speak directly to whoever started the whole problem. If it continues then file another.

Since it is happening at work, please give a written or email complaint to the supervisor concerned with copy to the HR department. Incase you do not have one, make sure to mark a copy to the chief of your organisation.
Get peer support - discuss the issue with your colleagues
Instead of suing, first talk to the HR director. That person may be able to put a stop to it---plus, if it continues, you will have documentation of complaints and actions.

I don't like namecalling, and others have suggested a course of action you can take at work. But this is not the kind of thing that should be taken to court, unless you have suffered serious financial loss. And in some jurisdictions, you may pay a lot more in legal fees than you will get in a settlement.
