If her parents catch us having sex, what charges can they file against me, if any can be filed?
Iam 17 years old, and she is 15. We live in Florida. Both are legal US residents.

Well its a mixed bag kid. Yes, her parents can charge you with statutory rape, endangering the welfare of a minor, blah blah, etc. DONT DO IT YET...
HOWEVER...
Floridas Age of consent is 18, BUT BUT BUT, anyone under the age of 24 can have sex with anyone SIXTEEN or older. So in other words, wait until she is 16. Then the worst they can technically do is pull out a restraining order. Well, there are some other applicables, but unless she is mentally retarded, physically handicapped, etc... I dont think they apply.
This is contained in Penal code 794.05
"(1) A person 24 years of age or older who engages in sexual activity with a person 16 or 17 years of age commits a felony of the second degree, punishable as provided in s. 775.082, s. 775.083, or s. 775.084. As used in this section, "sexual activity" means oral, anal, or vaginal penetration by, or union with, the sexual organ of another; however, sexual activity does not include an act done for a bona fide medical purpose."
This is commonly known as a "romeo and juliet" clause. The whole intention of AOC laws is to prevent adults from using thier position as in age or relation as a method of obtaining sex from a minor. Thankfully, most states recognize this reason, and have such a clause. If you were in NYS, (Like me!) you can legally have sex right now. (15 - 17 legal, however, 15 - 18 illegal, but 16 - under 20 legal, with 17 as AOC).

well techinally i think they can change u with sex with her because techinally u have to be an adult to consent to sex but no one does that. but if u turn 18 before she turns 16 you could get charged with statutory rape.

I don't see your situation being covered anywhere in the statute, so it might not be statutory rape. But I agree with the other posters - dude, you're cutting pretty close.
i live in florida also, and you cant be charged with anything because you are also a minor, but even if you do turn 18 before she does her parent still cant do anything because she is over 16 and she can decide who she wants to have sex with the only way they could charge you is if your girlfriend claimed you raped her.

OK, OK I'm just joking. You may be charged with statutory rape and sex with a minor. I would consider myself lucky if I lived to be charged . I know that if I caught someone doing my 15 year old daughter, I would be in jail for murder.
